Recognition of the professional qualification of probation counselor based on professional experience*

The procedure is intended for any citizen of a member state of the European Union, the European Economic Area, or the Swiss Confederation who wishes to practice the profession of probation counselor in Romania.

The procedure for testing skills and knowledge of the Romanian language, for the purpose of recognizing the applicant's professional qualification, is carried out under the conditions of Law no. 123/2006 regarding the status of probation staff, with subsequent amendments and completions, as well as Law no. 200/2004 regarding the recognition of diplomas and professional qualifications for regulated professions in Romania, with subsequent amendments and completions.

The professional qualification of probation counselor is certified based on a qualification title or, if applicable, professional experience.

Recognition of professional qualification based on professional experience grants the applicant the right to practice the profession of probation counselor in Romania under the same conditions as Romanian citizens, being able to be employed in a vacant position with the rank corresponding to the recognized seniority.

Professional experience means the actual and legal exercise, full-time or partial equivalent, of the profession of probation counselor in a member state of the European Union, the European Economic Area, and the Swiss Confederation.

Certificate regarding the physical and psychological health of the applicant. The document is requested in the member state of origin, for the exercise of the probation counselor profession; when the member state of origin does not request such a document, the original certificate issued by the competent authority of the member state of origin shall be submitted, proving that the applicant is medically and psychologically fit - in original, apostilled or, as the case may be, legalized, accompanied by the legalized translation.*

Criminal record certificate in original, issued by the Romanian authorities, as well as a criminal record certificate or an equivalent document, in original, issued by the competent authority of the applicant’s country of origin or provenance, showing that the applicant has no criminal record. For citizens of EU states, the criminal record certificate issued abroad shall be submitted in original accompanied by the multilingual standard form – translation aid instrument (Annex XI to European Union Regulation no.1191/2016) – original. Alternatively, it is possible to submit the apostilled/legalized certificate, as the case may be, accompanied by its legalized translation. For citizens of EEA states, the criminal record certificate issued abroad shall be submitted in original apostilled or, as the case may be, legalized, accompanied by its legalized translation.*

Appeal procedure: the decision to reject the application for acquiring the status may be challenged at the court of appeal in whose jurisdiction the claimant has their domicile or at the Bucharest Court of Appeal, in compliance with the provisions of the Administrative Litigation Law no. 554/2004, with subsequent amendments and completions.
