The application is submitted by the applicants—commercial companies, agricultural companies and other forms of association in agriculture, associations and foundations, agricultural cooperatives, any other legal form of association, according to the legislation in force—to MADR/MMAP, through DAJ/the Forestry Guard, for verification of compliance based on the criteria for producer groups in Annex 2, accompanied by the following documents: a. the request for recognition as a producer group/as per the form provided in Annex no. 3 b. copy of the decision/resolution of the management body/general assembly c. copy of the articles of incorporation and/or statute from which the fulfillment of the criteria in Government Ordinance no. 37/2005 should result d. proof of producer status for agricultural producers, as follows: - for natural person members, the producer certificate issued in accordance with the provisions of Law no. 145/2014 - for authorized natural persons, individual enterprises, and family enterprises established according to GEO no. 44/2008, and legal person members, a copy of the registration certificate at the trade register office/tax registration certificate, as applicable e. for agricultural producers, legal persons, documents proving that they have qualified personnel corresponding to the product group and/or products for which they are recognized, or to provide in the articles of incorporation that within the first year from recognition, they have this personnel or contract specialized services f. for forestry producers, the entity presents any document proving activity in the forestry field and proves professional training in the field, and the members of this entity own forest land g. the list of official members, drawn up as per the model form provided in Annex no. 4, approved by the general assembly/management body, according to the provisions of the articles of incorporation—in the mentions regarding the production material base specified in Annex no. 4, the size of the areas and type of crops in the case of crop farms, or the size of the livestock in the case of livestock farms, must also be indicated, from which it should result that the producer group/producer organization to obtain recognition can achieve a minimum value of commercialized production (VPC), according to the provisions of Government Ordinance no. 37/2005 h. copies of documents proving personnel qualification, as appropriate i. copies of contracts for specialized technical assistance services or own register with specific technical assistance activities provided through own personnel, as appropriate j. copies of the articles of incorporation of member legal persons k. members' affidavit regarding their belonging to another group or producer organization, in accordance with the provisions of Government Ordinance no. 37/2005 l. certificate issued in accordance with the provisions of Government Ordinance no. 37/2005, as applicable By exception to the provisions of EU Regulation no. 1,308/2013, in the situation where a member of a producer group/producer organization owns separate production units located in different geographical areas, they may be part of several recognized producer groups/producer organizations for the same group(s) of products, respectively for the same product(s), depending on the location of the production units, if they comply with the procedure for justifying this situation as established in the methodological norms for applying the legal provisions. The application is submitted by applicants for one or more product groups or for one or more products from the product groups mentioned in art. 6, para. 2 letter a, and letter b - Order 358/2016 commercial companies, agricultural companies and other forms of association in agriculture, associations and foundations, agricultural cooperatives, any other legal form of association according to the legislation in force, to MADR/MMAP, through DAJ/Forest Guard, for compliance verification based on the criteria for producer organizations in Annex 5, accompanied by the following documents: a. the application requesting recognition as a producer organization according to the form provided in Annex no. 3 b. a copy of the decision/resolution of the management body/general assembly mentioning its agreement to undertake the legal steps for obtaining recognition c. a copy of the articles of incorporation and/or the statute, from which it results that the criteria of Government Ordinance no. 37/2005 are met d. proof of the quality of producer for agricultural producers, as follows - members who are individuals present the producer attestation, issued in accordance with the provisions of Law no. 145/2014 - members who are authorized persons, individual enterprises, and family enterprises established according to GEO no. 44/2008 and members who are legal entities present a copy of the registration certificate at the trade register office/the tax registration certificate, as the case may be e. in the case of agricultural producers, the legal entity presents documents showing that it has qualified personnel corresponding to the product group(s) and/or product(s) for which it is recognized, or provides in the articles of incorporation that in the first year after recognition it will have such personnel or will contract specialized services f. in the case of forestry producers, the entity presents any document showing activity in the forestry field and proves professional training in the field, and the members of this entity own forest land g. the list of registered members, prepared according to the form provided in Annex no. 4, approved by the general assembly/management body, depending on the provisions of the articles of incorporation, from the mentions regarding the production material base specified in Annex no. 4, must also result the surface size and crop type, in the case of plant farms, respectively the livestock size in the case of animal farms, showing that the producer group/producer organization to be recognized can achieve a minimum VPC value, according to the provisions of art. 6 para. 2 of Government Ordinance no. 37/2005 h. copies of documents certifying the qualification of the personnel, as the case may be i. copies of specialized technical assistance service contracts or the own register of specific technical assistance activities provided through own personnel, as the case may be j. copies of the articles of incorporation of the member legal entities k. statutory declaration by the members regarding their membership in another group or producer organization, in accordance with the provisions of art. 6 para. 4 and 5 of Government Ordinance no. 37/2005 l. certificate issued in accordance with the provisions of art. 6 para. 5 of Government Ordinance no. 37/2005, as the case may be By way of exception to the provisions of EU Regulation no. 1308/2013, if a member of a producer group/producer organization holds its own separate production units located in different geographical areas, it may be part of several recognized producer groups/producer organizations for the same product group(s) or for the same product(s), depending on the location of the production units, if it follows the justification procedure for this situation established in the methodological rules for the application of legal provisions.*
