PRECIZĂRI

Art. 19, para. (2) of the Methodological Norms for the application of Law no.50/1991, approved by MDRL Order no. 839/2009, establish that the certificate of urbanism is an information document regarding the legal, economic, and technical regime of the property, as well as the specific urban requirements of the site, determined in accordance with the provisions of the approved and endorsed urban documentation, a document that is issued, upon request, to any applicant - natural or legal person - and for which it is not necessary to present the title of the property or any other document attesting the right of ownership.

The issuance authority is prohibited from conditioning the issuance of the certificate of urbanism on the prior preparation of urban documentation for the property in question, as well as any other technical documentation defining the purpose of the request.

Under these conditions, for the purpose of detailing the proposed urban intervention, other documents drawn up by a designer, consisting of plans on cadastral support showing the situation of existing and proposed constructions, and a technical memorandum describing in detail the proposals from the plans with an estimation of the impact of the proposed works on the neighbors, may be attached to the mandatory legal documentation; These plans are optional and have the sole purpose of providing information regarding the investor's intentions, and cannot be endorsed as unchangeable;.

The plans to be endorsed as unchangeable will be cadastral plan extracts on orthophotoplan or other plans issued/endorsed by the Constanța Office of Cadastre and Real Estate Publicity, highlighting the cadastral plots for which the certificate of urbanism is requested.

In the case of properties registered in the records of cadastre and real estate publicity, plans for zoning at one of the scales 1:10,000, 1:5,000, 1:2,000, 1:1,000, 1:500, as appropriate, issued at request, by the Office of Cadastre and Real Estate Publicity (OCPI), with the condition that these include a highlight of the cadastral plots for which the certificate of urbanism is requested, but do not contain proposals regarding constructive interventions at the plot level, can be endorsed as unchangeable as an annex to the certificate of urbanism. These endorsed plans may be used in the documentation required to obtain the approvals requested through the certificate of urbanism.

The boards containing intervention proposals, requested by institutions authorized to issue the necessary approvals, will be drafted on the topographic support endorsed by OCPI to be used for obtaining the construction permit, together with the plans endorsed as unchangeable as annexes to the certificate of urbanism, as mentioned in the previous paragraph.

Release of lost civil status certificates - Constanta City Hall*

This procedure regulates the method of issuing lost civil status certificates within the City Hall of Constanta Municipality.

Civil status certificates are issued upon request to the entitled person, based on the registrations and mentions entered in the civil status registers.

Civil status certificates are issued only to citizens who possess an identity document (ID card, valid temporary identity certificate). Romanian citizens residing abroad and foreign citizens whose civil status documents are registered in the country will be issued certificates based on their passport.

Persons who have their domicile in structuring localities other than those where the civil status registers are kept and cannot travel personally to obtain civil status certificates will address the city hall in comprehending whose jurisdiction they have their domicile or residence, indicating the locality where the document is located and the civil status data, for identifying the act.

The civil status officer who receives this request will, within 3 days, request the city hall keeping the civil status register to send the civil status certificate. The civil status officer who receives the completed civil status act invites the petitioner within 48 hours to collect it, under signature. The request for issuing the new certificate must include in detail the circumstances in which it was lost, stolen or destroyed.

For minor children who do not possess identity documents, as well as for those who are under interdiction, the birth certificate is issued to the parent or legal representative. For minors over 14 years old who possess identity documents, the birth certificate is issued personally. The presence of the parent/legal representative is mandatory.

The marriage certificate may be issued to either spouse or, upon request, to both spouses. For the surviving spouse or in case of divorce, for justified reasons, marriage certificates with the corresponding mentions may be issued.

The death certificate is issued to family members or other entitled persons.

Requests for obtaining civil status certificates from abroad are processed by the Ministry of Foreign Affairs – Consular Relations Directorate. CLARIFICATIONS

Art. 19, paragraph (2) of the Methodological Norms for the application of Law no. 50/1991, approved by MDRL Order no. 839/2009 establishes that the urbanism certificate is an information document regarding the legal, economic, and technical status of the real estate, as well as the specific urbanism requirements of the location, determined in accordance with the provisions of the approved and endorsed urbanism documentation, a document which is issued, upon request, to any applicant – natural person or legal entity – with no requirement to present the title over the property or any other document attesting ownership.

The issuer is forbidden to condition the issuance of the urbanism certificate on the prior preparation of an urbanism documentation for the respective property, as well as any other technical documentation defining the purpose of the request.

Under these conditions, for the purpose of detailing the proposed urban intervention, other documents prepared by a designer may be attached to the mandatory legal documentation, consisting of:

· Agreement/principle approval issued by the network owner;
· Technical report;
· Site plan on cadastral support on which the existing and proposed network will be highlighted in color - 2 copies, scale 1:500;(these plans are optional and serve exclusively as information regarding the investor’s intentions, and cannot be stamped “unchangeable”);· court decision regarding the establishment and CIF for owners’ associations;
· Isometric scheme of the natural gas usage installation and as-built plan showing the route of the apartment’s pipe to be connected to the column - 2 copies.The plans to be stamped “unchangeable” will be the cadastral plan excerpts on ortho-photo plans or other plans issued / approved by

CLARIFICATIONS


Art. 19, para. Under these conditions, for detailing the proposed urban intervention, other documents prepared by a designer may be attached to the legally mandatory documentation, consisting of plans on cadastral support with the situation of existing and proposed constructions and a technical memorandum in household the proposals in the plans are described in detail, with an estimate of the impact of the proposed works on the neighborhood; These plans are optional and have the exclusive purpose of informing about the investor's intentions, and cannot be stamped as unchangeable.

The plans to be stamped as unchangeable shall be the cadastral plan extracts on the orthophotomap or other plans issued/stamped by the Constanța Office of Cadastre and Real Estate Publicity, highlighting the cadastral plots for which the urbanism certificate is requested.

In the case of properties registered in the records of cadastral and real estate publicity, may be stamped as unchangeable as an appendix to the urbanism certificate, the zoning plans, at one of the scales 1:10.000,1:5.000, 1:2.000, 1:1.000, 1:500, as applicable, issued , on request, by the Office of Cadastre and Real Estate Publicity (OCPI), provided that these contain the highlighting of the cadastral plots for which the urbanism certificate is requested, but do not contain proposals regarding construction interventions at the plot level. These stamped plans may be used in the documentation necessary for obtaining the permits required by the urbanism certificate.

The layouts containing intervention proposals, requested by the institutions empowered to issue the necessary permits, will be drafted on the topographic support stamped by OCPI to be used for obtaining the building permit, together with the plans stamped as unchangeable as annexed to the urbanism certificate, mentioned in the previous paragraph.

Transcription requests are submitted in person, by the applicants or their legal representatives at the headquarters of the Local Directorate for Persons Records – Civil Status Service, located in Constanța municipality, 193 Mamaia Blvd (former School no. 1) Constanța, Constanța County. Working hours: MONDAY-FRIDAY between 08:30-13:30.

Married persons submit the request for the transcription of the marriage certificate/extract at the same time as the request for the transcription of the birth certificate/extract, including the birth certificate of the minor child, for whom they provide proof of acquiring/regaining Romanian citizenship.
The request for the transcription of the marriage certificate/extract can be submitted separately only if the petitioner provides proof that they have submitted the request for the transcription of the birth certificate/extract either previously at the Civil Status Service Constanța or at another competent civil status service. Proof is provided by the transcribed birth certificate.

The processing time for requests regarding the transcription of civil status certificates/extracts is 60 days calculated from the date the request is registered, according to art. 41 para. (5^1) of Law 119/1996 regarding civil status acts.

Information regarding the circulation of certain public documents between Member States

Under the Regulation, which promotes the free movement of citizens, starting February 16, 2019, certain public documents and their certified copies are exempt from the requirement of legalisation and apostille formalities for use in European Union Member States.

Thus, for these documents, you may request a multilingual standard form, to avoid the need for translation and apostille. The exemption from the requirement of legalisation and apostille formalities applies only to documents and their certified copies issued by the public authorities of a Member State and presented to the public authorities of another Member State. The documents are as follows:

- documents issued by a court or by a court official;

- administrative documents;

- notarial acts;

- official certificates attached to private documents;

- diplomatic and consular documents.

In addition, the exemption applies exclusively to documents establishing one or more of the following elements:

- birth;

- death;

- the fact that a person is alive;

- name;

- marriage, including capacity to marry and marital status;

- divorce, legal separation, or marriage annulment;

- registered partnership, the capacity to enter into a registered partnership, and status of registered partnership;

- dissolution of a registered partnership, legal separation, or annulment of a registered partnership;

- parentage or adoption;

- domicile and/or residence;

- citizenship;

- absence of a criminal record;

- the status of candidate or participation in elections to the European Parliament or in local elections in another Member State.

Highlighted items indicate the existence of a multilingual standard form for these documents. Please note that not all standard forms are issued in all Member States.

The multilingual standard form can be used only in another Member State and must be presented together with the official document it accompanies.

When a Member State allows for the presentation of a certified copy of a public document instead of the original, the authorities of the respective Member State must accept a certified copy prepared in the Member State in which the document was issued.

Issuing the identity card upon reaching the age of 14 - Constanta City Hall*

The procedure describes the documents required for issuing the identity card upon reaching the age of 14. The minor must appear at the counter of the public community service for people records, accompanied by one of the parents or, as the case may be, by their legal representative, by the person designated from the specialized center under the authority of the Public Social Assistance Service, or by the person to whom the minor has been entrusted for placement.
IMPORTANT

The minor’s domicile is with their parents or with the parent where they live permanently.

The application for issuing the minor’s identity document cannot be completed with any other address, except for the domicile address of the parents or the parent with whom the minor has their domicile, according to the law.

When the parents have different domiciles, the application for issuing the identity document is signed by the parent at whose domicile the minor resides, in accordance with the law.

For a minor who, although entrusted by court decision/agreement to one of the parents, lives permanently with the other parent, the consent declaration of the parent to whom the minor was entrusted is requested, stating that they agree for the address at which the minor permanently resides to be registered in the identity document.

The consent declaration can be given at the counter, in the presence of the personnel of the people records service, and if the parent cannot appear at the counter, the declaration must be authenticated at the public notary or, as the case may be, at the Romanian diplomatic mission in the state where the parent is present.

Upon submitting the documents, the minor will be obligatorily accompanied by one of the parents or, as the case may be, by the legal representative, the person designated from the specialized center under the authority of the public social assistance service, or by the person to whom the minor has been entrusted for placement.

GEO no. 97/2005, Art. 12:

(1) Within 15 days of reaching the age of 14, the minor is obliged to request the public community service for people records to issue the identity document;

(2) The issuance of the first identity document cannot be done based on a special power of attorney.

  • The EIC is handed to one of the parents/person mentioned in Art. 121 of the Government Emergency Ordinance no. 97/2005, republished, with its subsequent amendments and completions;

Minors who have not reached the age of 14 are NOT issued a simple identity card.

If the scheduled persons are late for their appointment, they must reschedule themselves in person for a later date.

If the persons arrive earlier than the scheduled time, they will only be attended to at the scheduled time.
